Terms and Conditions of Service

1. Identification This document sets forth the Terms and Conditions ("Terms") governing access to and use of the energy advisory and switching services (the "Service") provided by AP Venture 1 SL (trading as Llama.Energy), a company legally registered in Spain with its business address at Ronda de Sant Pau, 47, Eixample, 08015 Barcelona, Spain ("Llama.Energy," "we," or "us"). ‍2. Service Description Llama.Energy offers a digital subscription-based service that helps users optimize their electricity contracts. We analyze electricity consumption, compare tariffs on the market, and automatically switch users to better plans when applicable. Our service is independent from any energy company.

‍3. User Acceptance and Subscription By subscribing to our Service, you accept these Terms and grant us a limited Power of Attorney to manage electricity contract switching on your behalf. The subscription involves an annual fee, the amount of which is communicated at the time of subscription. By accepting these Terms, you authorize Llama.Energy to:Monitor your electricity consumption and market offers.Negotiate and subscribe to new electricity contracts in your name.Cancel existing electricity contracts if switching to a better one.Set up direct debit payments with energy providers.The Power of Attorney is effective upon your acceptance of these Terms and remains valid until your subscription is cancelled.

‍4. Automatic Switching Llama.Energy may automatically switch your electricity provider when a better offer is available, according to the preferences you indicate. You will be notified after the switch. If you do not agree with automatic switching, do not subscribe to the Service.

‍5. User Obligations Users agree to:Provide accurate and complete information during signup.Refrain from using the platform in any way that causes damage, illegal activity, or unauthorized access to systems.Update personal and consumption information as needed.Confirm that they are the legal holder of the electricity supply contract and have the authority to grant Llama.Energy permission to manage, modify, or switch it on their behalf.

‍6. Fees and Cancellation The subscription fee is annual and paid directly to Llama.Energy. You may cancel your subscription at any time. The Service will remain active until the end of the billing cycle.

‍7. Disclaimer of Liability While we make every effort to ensure savings and optimal switching, we do not guarantee that you will save money. The Service is provided "as is," and Llama.Energy shall not be liable for issues arising from third-party energy providers.

‍8. Right of Withdrawal As a consumer, you have the right to withdraw from the subscription within 14 calendar days from the date of acceptance without providing a reason. To exercise this right, contact us via WhatsApp at +34 662 36 56 44 or by email at customers@llama.energy.

‍9. Privacy and Data Protection We collect and process your personal data (including name, contact details, and electricity usage) strictly in accordance with our [Privacy Policy]. By accepting these Terms, you confirm that you have read and accepted our Privacy Policy.

‍10. Communication Methods All communications with Llama.Energy will primarily take place via WhatsApp or email. It is your responsibility to ensure that your contact details are up to date. We may use these channels to notify you about important account updates or automatic switching actions.

‍11. Platform Usage and Conduct Users agree not to misuse the Llama.Energy website or services. This includes but is not limited to:Attempting to access unauthorized areas of the platform.Using the platform to engage in any fraudulent, unlawful, or harmful activity.Reverse-engineering, copying, or replicating any part of the service without express permission.

‍12. Service Limitations While Llama.Energy aims to ensure uninterrupted service, we do not guarantee continuous access. Temporary disruptions due to maintenance, upgrades, or force majeure events may occur.

‍13. Modifications to the Terms We may modify these Terms from time to time. Updated versions will be posted on our website, and we may notify you via WhatsApp or email. Continued use of the Service after such modifications constitutes acceptance of the revised Terms.

‍14. Governing Law and Jurisdiction These Terms are governed by Spanish law. Any disputes arising in connection with the interpretation or application of these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
