Terms and Conditions of Service
Identification This document sets forth the Terms and Conditions (“Terms”) governing access to and use of the energy contract advice and exchange services (the “Service”) provided by AP Venture 1 SL (trading as Llama.Energy), a company legally registered in Spain with registered office at Ronda de Sant Pau, 47, Eixample, 08015 Barcelona, Spain (“Llama.Energy”, “we”, “us”, “our” or “our”). 2.Service Description Llama.Energy offers a subscription-based digital service that helps customers optimize their electricity contracts. We analyze electricity consumption, compare market rates and automatically switch users to better plans when applicable. Our service is independent of any electricity company.
3.User Acceptance and Subscription By subscribing to our Service, you accept these Terms and grant us a limited power of attorney to manage the change of electrical contract on your behalf. Subscription involves an annual fee, the amount of which is communicated at the time of registration. By accepting these Terms, you authorize Llama.Energy to:Monitor your electricity consumption and market offers.Negotiate and contract new electricity supplies on your behalf.Cancel existing contracts if a better offer is found.Set up direct debit payments with retailers.The power of attorney comes into effect upon acceptance of these Terms and remains valid until the subscription is cancelled.
4.Automatic Contract Switching Llama.Energy can automatically switch your electricity supplier when a more advantageous offer becomes available, based on the criteria you specify. You will be notified after the change is made. If you do not agree to automatic switching, do not subscribe to the Service.
5.User Obligations Users agree to:Provide accurate and complete information when registering.Not use the platform in a way that causes damage, illegal activities or unauthorized access to systems.Keep their personal and consumption information up to date.Confirm that they are the legal holder of the electricity supply contract and that they have the authority to grant Llama.Energy permission to manage, modify or change it on their behalf.
6.Fees and Cancellation The subscription fee is annual and is paid directly to Llama.Energy. You may cancel your subscription at any time. The service will remain active until the end of the current billing cycle.
7.Disclaimer Although we make every effort to ensure optimal savings and switching, we do not guarantee that you will save money. The Service is provided “as is”, and Llama.Energy will not be responsible for problems arising from energy suppliers.
8.Right of Withdrawal As a consumer, you have the right to withdraw from the subscription within 14 calendar days from the date of acceptance without justification. To exercise this right, contact us by WhatsApp at +34 662 36 56 44 or by email at customers@llama.energy.
9.Privacy and Data Protection We collect and process your personal data (including name, contact details and electricity consumption) strictly in accordance with our [Privacy Policy]. By agreeing to these Terms, you confirm that you have read and accepted our Privacy Policy.
10.Means of Communication All communication with Llama.Energy will be done preferably by WhatsApp or email. It is the user’s responsibility to keep their contact details up to date. We may use these channels for important notifications or about automatic contract changes.
11.Platform Use and Conduct Users agree not to misuse the Llama.Energy website or services. This includes, but is not limited to:Attempting to access unauthorized areas.Using the platform for fraudulent, illegal or harmful activities.Reverse engineering, copying or replicating any part of the service without express authorization.
12.Service Limitations Although Llama.Energy strives to provide uninterrupted service, it does not guarantee continuous access. Temporary interruptions may occur due to maintenance, upgrades or force majeure.
13.Modification of the Terms We may modify these Terms at any time. Updated versions will be posted on our website, and we may notify you by WhatsApp or email. Your continued use of the Service constitutes acceptance of the modified Terms.
14.Applicable Law and Jurisdiction These Terms are governed by Spanish law. Any dispute relating to the interpretation or application of these Terms shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.
